Terms and Conditions

Last updated: 6 June 2024

These Terms and Conditions ("Terms") govern the provision of virtual assistant services (the "Services") by Funape to any person or business who engages those Services (the "Client", "you"). By placing an order or otherwise instructing Funape to provide the Services, you agree to be bound by these Terms. Please read them carefully before proceeding.

1. Who We Are and How to Contact Us

The Services are provided by:

These Terms are governed by the law of England and Wales. If you are a consumer, nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or other applicable UK consumer legislation.

2. Placing and Confirming an Order

Orders for the Services may be placed through our website, by email, or by telephone. An order constitutes an offer by you to purchase the Services described in that order. No contract exists between you and Funape until we send you a written confirmation, whether by email or through our website, accepting your order and setting out the scope of work, agreed timeframe and applicable fee.

We reserve the right to decline any order at our discretion, for example where the requested task falls outside our area of competence or availability. In such cases, any payment already made will be refunded in full.

3. Prices, Payment and What Is Included

All prices are quoted in pounds sterling (GBP) and are inclusive of any applicable UK value added tax unless stated otherwise at the time of quotation. The price confirmed in your order confirmation reflects the specific scope of work agreed with you; any additional tasks, revisions beyond an agreed number, or extended hours will be quoted and agreed separately before being carried out.

Payment is due in accordance with the terms set out in your order confirmation, which may include payment in advance, upon completion, or on a recurring basis for ongoing engagements. We accept payment by the methods indicated on our website or invoice. Late payment may result in suspension of ongoing work until outstanding sums are settled.

4. Cancellation and Complaints

4.1 Cancellation

If you are a consumer and the contract was entered into at a distance (for example, online or by phone), you generally have the right to cancel within 14 days of the order confirmation, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Please note that if you request the Services to begin before the end of this 14-day period and the work is fully performed, you may lose the right to cancel once performance is complete; if performance has started but is not complete, you may be required to pay for the proportion of the Services already provided.

For ongoing or subscription-based engagements, either party may cancel by giving written notice as specified in the order confirmation. Fees already paid for work completed prior to cancellation are non-refundable.

4.2 Complaints

If you are unhappy with any aspect of the Services, please contact us at info@funape.click with details of your concern. We aim to acknowledge complaints within 5 working days and to work with you towards a fair resolution, which may include correction of the work, a partial refund, or another appropriate remedy.

5. Limitation of Liability

We will provide the Services with reasonable care and skill. However, to the fullest extent permitted by law, Funape shall not be liable for any indirect or consequential loss, loss of profits, loss of business opportunity, or loss of data arising from the use of the Services. Our total liability arising out of or in connection with any single order shall not exceed the total fees paid by you for that order.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability which cannot lawfully be excluded or limited under English law.

6. Cookies and Privacy

Our website sets only one cookie, named cookie_choice_v1, which stores your cookie consent preference for a period of one year. We do not use any analytics, tracking or session cookies of any kind. Advertising measurement tools, where applicable, run only after you have given consent, and only on the order confirmation page. For further information on how we handle personal data, please refer to our Privacy Policy or contact us using the details above.

7. Your Rights

If you wish to exercise any right described in these Terms, including cancellation, complaint, or a query regarding your personal data, please contact us at info@funape.click. If you remain dissatisfied with how we handle a data protection matter, you have the right to lodge a complaint with the Information Commissioner's Office (ICO), the UK's independent supervisory authority for data protection.

8. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Services or applicable law. The version published on our website at the time of your order shall apply to that order. Continued use of our Services after any update constitutes acceptance of the revised Terms.
